Judge: Malone confession voluntary

Judge Mark Kruse ruled that Majestic Malone’s confession was voluntary in an order filed yesterday.

Previously, Malone’s attorney argued that police officers told Malone it was time to talk as they were taking his DNA. His attorney also argued Malone was lied to by deputies about why he was being taken out of his cell and where he was going.

However, Kruse said he found the testimony of Detective Tripp to be more truthful than that of Malone. Tripp testified that he was at the jail collection Malone;s DNA when Malone asked to speak with him.

Kruse specifically said this was clear in Malone’s Confession. Among these statements include a portion where Malone says he knows what he is doing in respect to this sixth amendment rights.

Malone’s trial begins today with Jury Selection.
