A witness in the trial of Majestic Malone and Markell Price said he saw Price and Malone take Breuer into the upstairs apartment on Acres street where he was killed.

The witness, who is a minor, said he had been hanging out with his girlfriend when Owen Laird asked for his help moving. That was when laird got a phone call and asked to be taken to Laird’s new residence on Acres Street.

When they arrived, Laird got out of the truck and approached Baldwin and Breuer while Breuer was on the ground. Laird began questioning Breuer about what Breuer had stolen from Laird’s house.

He said he did see Owen Laird chase Breuer down Elm Street and he hit Breuer a number of times. The Witness also saw Stanley Baldwin strike Baldwin’s hand with a metal pipe. He also saw Breuer escape and Laird chasing him down as Baldwin was on the phone laughing. When Laird caught up with Breuer, he pushed Breuer on the ground and hit Breuer somewhere between five and ten times.

Eventually he saw Malone and Price arrive. He said he saw Price arrive with Evan Laird and Malone came in a separate vehicle. The witness testified he saw the men take Breuer up stairs and later drug him down the stairs and out of the house by his hand. He also said Price later poured Soda on Breuer’s head.

The witness also said he saw Stanley Baldwin tell Owen Laird something and at one point said he heard Baldwin telling Laird to take the blame for the murder.

The witness also testified he gave later gave conflicting statements to police because he was scared.

Initially he told police he didn’t see anything. He later told police that he was afraid of what might happen to him and his girlfriend if he told the truth of what happened.

Under cross examination, defense attorney Hedi Van Winkle pointed out that the witness was on his phone, speaking with his girlfriend, and driving around the block to let other cars through. So while he did see some of what was going on, he could not really see everything that happened.
