Tenants at the Midtown Gardens Apartment Complex in Burlington could spend the rest of the summer in sweltering conditions if the Burlington Housing Board of Appeals does not grant them more time to take down improperly installed air conditioning units that are currently in violation of Housing Code.

Midtown Gardens does not have central air conditioning, and the windows installed in the 60-unit complex are horizontally, not vertically sliding. In order to install window air conditioning units, which are purchased by the renter, a plywood board, provided by the company, is used to keep the unit in place.

However, the plywood board does not allow the window to be opened in case of an emergency, such as a fire, presenting an egress issue that violates Burlington Housing Code for rental properties. According to residents, Seldin Company, which owns Midtown Gardens, used to install the boards and air conditioning units themselves until being notified in January of the code violation. Once notified, residents have been required to install the boards themselves.

Earlier this month, however, a note was left on resident’s doors that they had to remove the window AC unites by no later than August 5th after the complex once again was notified by the city that the boards presented an egress issue.

Maria Martinez lives at Midtown Gardens, she says not having air conditioning in the dead-heat of summer is simply not reasonable.

“There’s a lot of kids who live here who have asthma and breathing problems,” Martinez told KBUR, “As for me, I’m really not supposed to be in the heat…I have two dogs, both inside dogs. It gets very hot.”

LJ Price is another tenant. He says that not having an Air Conditioner puts his 18 month old daughter and pregnant fiance in danger.

“It’s like living in a pizza oven if you do not have an air conditioner upstairs,” Price said, “I’m not a doctor, but I don’t believe that it’s good for her health to be in 90+ degree temperatures while she is trying to sleep or trying to live.”

Some residents say that they will refuse to comply with the order to take down the units until the heat of summer has passed.

Seldin Company has appealed the city’s order to take down the units. They’re scheduled for a hearing on August 12th at 5:30pm at Burlington City Hall.

On Friday, property manager Michala Cross informed tenants that they would be allowed to keep their AC’s installed through the appeals process.

Burlington Police have arrested one following an early morning assault and robbery that hospitalized the victim on Thursday.

20 year old Keith Lashun Metz of Opelousas, Louisiana, was arrested after police say he and another man, 36 year old Tremaine “Donald” Dlanod Perine of Alabama assaulted and robbed a man following a dispute over property in the 2300 block of Vogt Street. The men were known to the victim.

Metz was charged with 2nd degree robbery. Perine is still at large. Police are asking the public to call 911 immediately if they know of Perine’s whereabouts. He is to be considered armed and dangerous and may have left the area.

Police do not believe that the attack was a random act.

Burlington Police have arrested the woman whom they believe is responsible for the July 25th knifepoint robbery of Burke Cleaners on Roosevelt Avenue.

47 year old Urealeen Orlanda Weemas, of Fairfield, allegedly walked in to the store at around 2:00pm wielding a knife and demanding money.

She was arrested Wednesday without incident and taken to the Des Moines County Jail, awaiting an appearance in court.

Lee County Narcotics Task Force Officials have arrested a woman who they believe has been dealing lysergic acid diethylamide–LSD that is, in southeast Iowa.

“We see [LSD] probably a couple of times every two or three years,” said Lee County Narcotics Task Force Commander Stacy Weber, “We hear it’s out there, and sometimes we’re lucky enough to shut down a dealer.”

32 year old Jessica Ann Harwood was arrested at the Fort Madison Police Department and Charged with Delivery of LSD. If convicted, she could face 25 years in prison.

The man who was arrested following a chase with Des Moines County Sheriff’s Deputies last week has been hit with new charges stemming from a chase that occurred earlier this month in which he successfully escaped police.

29 year old Brandon Beach was initially arrested by police on the Morning of July 23rd following a short chase, but two weeks earlier, Beach was allegedly involved in another car chase, this one, with West Burlington Police Officers. That chase wound through both Des Moines and Henry Counties before police lost track of Beach after he went into a corn field.

In addition to his previous charges, which included traffic violations and possession of drug paraphernalia as well as warrant charges, Beach has 12 new charges related to the chase earlier this month, including a charge of having an open container of alcohol in the car.

The lawyer representing Ex-City Councilman and Photography Studio Owner Chris King has filed two motions in Des Moines County Court to push back against charges that he sexually assaulted several teenage girls after luring them on social media and through his photography business.

Court records show that the first motion asks for a reduction in his bond, currently set at $40,000, cash-only. King was able to successfully reduce his bond once before, following his first arrest in May.

The second motion asks for a change of venue away from Des Moines county, arguing that media attention surrounding the trial would irreparably bias local jurors.

Several parents contacted Burlington Police in February, concerned that King had sexually abused their teenage daughters. Police say that King, on multiple occasions, contacted teenage customers through social media following their initial sitting, offering them “discounts” on their photo sessions if they came to the studio to “assist” King.

King would then, allegedly, provide the teenage girls with alcoholic beverages and drive to locations in rural Des Moines county, where according to police, he would abuse his victims.

A Burlington man is facing 14 separate criminal charges after drunkenly getting into a car chase with West Burlington Police before wrecking his car in a ditch on Saturday–all with three children in the car.

Police first tried to stop 39 year old Anthony Maurice Walls for speeding in West Burlington when Walls allegedly took off at high speed down Roosevelt and West Burlington Avenues, reaching speeds of about 80 miles an hour before West Burlington Police Chief Frank Newberry ordered officers to discontinue the chase, four minutes after it began at 9:04pm.

About an hour later, Des Moines County Sheriff’s deputies discovered Walls’ car in a ditch in rural Des Moines County.

Walls was arrested and charged with three counts of Child Endangerment, Driving Under the Influence, Reckless Driving, Driving with a Suspended License, No Insurance, Speeding, Felony Eluding, Following Too Closely, Failure to Use a Turn Signal, Failure to Obey a Stop Sign, Failure to Maintain Control, and Failure to Obey a Traffic Control Device.

Projects are currently underway with both the Burlington Public Works Department and the Iowa Department of Transportation, and more projects are on the way.

Currently, city crews are working on a street overlay project on Garfield from Barrett to West Avenue, and a sewer separation project affecting Division Street between Marshall, Gunnison and 6th and 7th streets. But that’s not all the work that’s happening on Division, according to City Engineer Ryne (Rhine) Thornburg. They’ll be resurfacing the street in addition to separating the sewer line.

“Division Street is going to be disrupted for a fairly long time,” Thornburg told KBUR Talk Show Hosts Steve Hexom and Rob Sussman, “Between 6th and 7th, they’re having to jackhammer through some bedrock so it’s taking [them] longer than anticipated.”

These projects are running concurrently with several projects being undertaken by the Iowa Department of Transportation on Highway 61 and it’s various overpasses and off ramps in town. Work on the Curran Street off ramps on the east side of the overpass have been ongoing since the 20th, and they aren’t expected to finish up for several more weeks. The overpass on 5th street is also being resurfaced. Another DOT resurfacing project is starting on Monday: they’ll be working to resurface one of Burlington’s busiest overpasses: the overpass carrying Highway 61/Roosevelt Avenue over Highway 34.

“There will be two lane traffic each way, during construction, in multiple phases… it’ll be reduced to one lane of traffic each way,” said Public Works Director Steve Hoambrecker.

Compounding the construction issues, Hoambrecker says it’s possible that the Iowa DOT will install a new girder to replace a damaged one on the Eastbound Main Street off ramp at the same time that the other projects will be taking place. That means that two of Burlington’s four highway exits could be closed, with another reduced to two lanes.

Hoambrecker says that increased road fund revenue as a result of the gas tax is partially to blame for the number of road projects.

The construction work should be mostly wrapped up by the end of the summer.

Terry Branstad has extended a state of disaster emergency through Aug. 30 in response to the bird flu outbreak in the state.

The declaration Tuesday is the third extension of the original disaster proclamation. It otherwise would have expired Friday.

The virus has infected more than 31.5 million birds in Iowa, mostly egg-laying chickens, making the state the hardest hit in the nation.

Branstad’s declaration activates disaster response programs, allows the use of state supplies and makes other efforts to speed response efforts.

Branstad says disposal of dead birds and disinfection of barns has been completed and turkey farms are expected to be ready for restocking by the end of August. Some chicken operations may be ready for new birds in September.
