Federal court upholds denial of qualified immunity for Burlington police officer

Burlington, IA-  The 8th U.S. Circuit Court of Appeals has upheld a court order denying qualified immunity to a Burlington Police Officer.

The Hawk Eye reports that the opinion was filled on March 10th by three 8th circuit judges.  The ruling means that the civil case against the City of Burlington and BPD officer Chris Chiprez by Altovese Williams and the estate of her son MarQuis Jones will go to trial, unless the parties reach a settlement.

The suit alleges that Jones had dropped a gun while fleeing a traffic stop in 2017 and was lying on the ground when he was fatally shot.  Officer Chiprez later claimed that Jones was “taking a firing position.”

Burlington City Manager Chad Bird said that the city and its insurance provider are discussing a settlement.
